Affiliate Program Agreement

This Affiliate Program Agreement ("Agreement") is entered into between Sew Thrifty LLC ("Sew Thrifty," "we," "us," or "our") and you ("Affiliate," "you," or "your"). By submitting an application to join the Sew Thrifty Affiliate Program and checking the box indicating your acceptance, you agree to be bound by the terms of this Agreement.

1. Program Overview

The Sew Thrifty Affiliate Program allows approved participants to earn commissions by referring new buyers to the Sew Thrifty marketplace. Affiliates receive a unique promotional code to share with their audience.

2. Eligibility Requirements

To participate in the Affiliate Program, you must:

• Have an active Sew Thrifty seller account in good standing
• Have at least 5 active listings to join the program
• Maintain at least 3 active listings at all times to remain in the program
• Be at least 18 years of age
• Provide accurate and complete information in your application

If your active listings fall below 3 at any time, your affiliate status will be paused until you meet the minimum listing requirement again. During this time, your promotional code will be inactive and will not generate commissions or provide discounts.

3. Commission Structure

Affiliates earn commissions as follows:

• Commission Rate: 3% of the original order subtotal (before discount)
• Buyer Discount: Buyers using your code receive 5% off orders of $50 or more
• Qualifying Orders: First purchase only; the code applies once per customer
• Order Minimum: Orders must be $50 or more (before discount) to qualify

4. Payment Terms

• Payment Method: Commissions are paid via Stripe. You must have a connected Stripe account to receive payments.
• Payment Schedule: Payouts are processed monthly, typically on the 1st of each month, for completed orders from the previous month.
• Minimum Threshold: A minimum balance of $10 is required for payout. Balances below $10 will roll over to the following month.
• Order Completion: Commissions are only earned on completed orders. An order is considered complete approximately 14 days after shipping, once the buyer protection period has ended.
• Reversals: Commissions will be reversed for cancelled, refunded, or disputed orders.

5. Promotional Guidelines

When promoting Sew Thrifty, you agree to:

• FTC Compliance: Clearly disclose your affiliate relationship in accordance with Federal Trade Commission (FTC) guidelines. Include statements such as "This post contains affiliate links" or "I may earn a commission if you make a purchase."
• Accurate Representation: Represent Sew Thrifty and its services honestly and accurately. Do not make false claims about the platform, sellers, or products.
• Brand Guidelines: Use Sew Thrifty branding and logos only as provided or approved by us.

6. Prohibited Activities

Affiliates may NOT:

• Use spam, unsolicited emails, or deceptive marketing practices
• Bid on Sew Thrifty branded keywords (e.g., "Sew Thrifty," "SewThrifty") in paid search advertising
• Create websites or social media accounts that impersonate or could be confused with official Sew Thrifty properties
• Use cookie stuffing, ad injection, or other fraudulent techniques
• Offer additional unauthorized discounts or incentives beyond the standard affiliate discount
• Engage in any activity that violates applicable laws or regulations
• Make disparaging statements about Sew Thrifty, its sellers, or its buyers

7. Self-Referrals

You may use your own affiliate code on your first purchase. However, your code will only work once per customer, including yourself. Subsequent purchases you make will not generate commissions or discounts.

8. Intellectual Property

Sew Thrifty grants you a limited, non-exclusive, non-transferable license to use our name, logo, and approved marketing materials solely for promoting the Sew Thrifty marketplace as part of this program. This license terminates immediately upon termination of your participation in the program.

9. Term and Termination

This Agreement begins when your affiliate application is approved and continues until terminated by either party.

• Termination by You: You may terminate your participation at any time by contacting us at help@sewthrifty.com.
• Termination by Us: We may terminate your participation at any time, with or without cause, by providing notice to your registered email address.
• Effect of Termination: Upon termination, your promotional code will be deactivated. You will receive payment for any valid pending commissions that have already been earned on completed orders, subject to the minimum payout threshold.

10. Modifications to the Program

We reserve the right to modify commission rates, payment terms, eligibility requirements, or any other aspect of the Affiliate Program at any time. We will notify affiliates of material changes via email. Continued participation after such notice constitutes acceptance of the modified terms.

11. Disclaimer and Limitation of Liability

THE AFFILIATE PROGRAM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. SEW THRIFTY DOES NOT GUARANTEE ANY LEVEL OF EARNINGS OR SALES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEW THRIFTY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE AFFILIATE PROGRAM.

12. Independent Contractor

You are an independent contractor and not an employee, partner, or agent of Sew Thrifty. Nothing in this Agreement creates an employment, partnership, or agency relationship. You are solely responsible for all taxes related to your affiliate earnings.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
